UGANDA: Scheduling Conference For ‘Rogue and Vagabond’ Petition Adjourned To 25th September 2019

Today the petition challenging the constitutionality of Section 168 (1) (c) and (d), of Uganda’s Penal Code Act, which creates the offence of ‘being rogue and vagabond,’ Francis Tumwesige Vs Attorney General, Constitutional Petition No.36 of 2018, came up for conferencing between the petitioner and the respondent’s counsel. However, the Attorney General’s office neither appeared nor had they served their conferencing notes on the petitioner’s counsel. The registrar, Her Worship, Agnes Nkonge, therefore gave the petitioners’ counsel an opportunity to review the Attorney General’s conferencing notes, and to file their rejoinder by 23rd August 2019. She also adjourned the scheduling conference to 25th September 2019. The scheduling conference is key to enabling both parties iron out the particular issues they want the constitutional court to determine in adjudicating over the petition.
